Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Products and Services Offered

We offer the following products and services: Water Refills, Bottled Water, Water Containers, Water Dispensers, Reverse Osmosis Systems, Water Pumps, Ice Cubes, and Consulting Services.

2. General Conditions

Accuracy of Information: We attempt to be as accurate as possible in the description of our products and services. However, we do not warrant that product descriptions or other content of this site are completely accurate, complete, reliable, current, or error-free.

Pricing: All prices are subject to change without notice. The price charged will be the price in effect at the time of placing the order. We reserve the right to correct any pricing errors that may occur.

Availability: All orders are subject to product availability. We reserve the right to discontinue any product or service at any time.

3. Product-Specific Terms

A. Water Refills and Bottled Water

Quality: We commit to maintaining the highest standards of water quality, adhering to all local health regulations.

Refill Responsibility: Customers are responsible for ensuring that any Water Containers provided for refill are clean, undamaged, and suitable for holding drinking water. We reserve the right to refuse to fill any container deemed unsafe or unhygienic.

B. Water Containers, Dispensers, Pumps, and Systems

Warranty: New equipment (Water Dispensers, Reverse Osmosis Systems, Water Pumps, Water Containers) may be covered by a manufacturer’s warranty. Details of any applicable warranty will be provided with the product. We are not the manufacturer and generally do not offer a separate company warranty.

Installation/Set-Up: For complex products like Reverse Osmosis Systems and Water Pumps, any installation or set-up services will be covered by a separate agreement and may incur additional charges.

Risk of Loss: The risk of loss and title for all items purchased passes to you upon our delivery to the carrier.

C. Ice Cubes

Storage: Customers are responsible for the immediate and appropriate storage of Ice Cubes after delivery or pickup. We are not responsible for melting after the point of exchange.

4. Consulting Services

Scope: Consulting services are advisory only. We will provide recommendations and expertise based on the information provided by the customer.

No Guarantee: While we strive for positive outcomes, we cannot guarantee specific results from our consulting services. The implementation and final results are the responsibility of the customer.

Payment: Fees for consulting services will be outlined in a separate service agreement or quote and are payable as specified therein.

5. Orders, Payment, and Delivery

Order Acceptance: Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason.

Payment: Payment must be received by us prior to our acceptance of an order. We accept cash, EFT & Card payments.

Delivery: Delivery times are estimates and are not guaranteed. We are not responsible for delivery delays outside of our control. The customer is responsible for providing accurate delivery information and being available to receive the order.

6. Returns and Refunds

Consumables (Water, Ice Cubes): Due to the perishable nature of Water Refills, Bottled Water, and Ice Cubes, these are generally non-refundable and non-returnable once they leave our possession, except in cases of verifiable quality issues at the time of delivery/pickup.

Equipment: Returns for Water Dispensers, Reverse Osmosis Systems, Water Pumps, and Water Containers may be accepted within 7 days of purchase, provided the items are unused, in their original packaging, and in resalable condition, subject to a potential restocking fee.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of PhD Water pty (LTD) and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of PhD Water pty (LTD).

8. Limitation of Liability

In no event shall PhD Water pty (LTD), nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days' notice before any new terms take effect.
